The Law Society of Kenya and the Katiba Institute sought to prevent 50 Chief Administrative Secretaries (CASs) from assuming office by filing a Constitutional Petition in the High Court of Kenya.
However, on 24th March 2023, Justice Ongúdi granted Conservatory Orders which prevented the CASs from assuming or continuing to act as Chief Administrative Secretary until the case is heard.
The President and the Public Service Commission, as well as the 50 CASs as interested parties, have been served with the orders today.
The orders specify that the CASs are prohibited from earning any salary, remuneration, or any other benefit until the court decides on the matter.
The 50 interested parties, who are named in the petition, are allowed to obtain copies of the Petition and Application from the High Court, Constitutional and Human Rights Division.
Overall, the orders granted by Justice Ongúdi have put a halt to the assumption of office by the 50 CASs until the case is heard.
The orders also prohibit these individuals from receiving any form of payment until the court decides on the matter.
The case is scheduled to be mentioned on 21 April 2023.
